Service Agreement

1.

Acceptance of Agreement

1.1.

This Terms of Service Agreement (the "Agreement") is entered into between Dotberry Ltd., a company incorporated under the laws of Hong Kong (the "Dotberry", "Company", "we"), and the person accepting these terms (the "User", "you").

1.2.

By using dotberry.com, creating an account, or using our services, you confirm that you have read, understood, and unconditionally accept all terms of this Agreement, including the Privacy Policy (Part II), the Acceptable Use Policy (Part III), and the TLD Rules.

1.3.

If you disagree with any term of this Agreement, you must immediately cease using dotberry.com and Dotberry services.

1.4.

Dotberry may unilaterally amend the terms of this Agreement. The current version is always available at dotberry.com/terms. Continued use of the services following publication of any changes constitutes your acceptance of the revised Agreement.

1.5.

This Agreement is made in Russian and English. In the event of any conflict between the language versions, the English version shall prevail for users who have selected English as their interface language.

2.

Registration and Account

2.1.

To use Dotberry services, you must create an account by providing a valid email address. Dotberry does not require a name, surname, postal address, or phone number for standard registration.

Dotberry adheres to the principle of minimal data collection. Your email address is used solely to deliver service notifications and is not shared with third parties for commercial purposes.

2.2.

You are solely responsible for the security of your account credentials and for all actions taken through your account. Dotberry is not liable for any losses arising from unauthorised access to your account due to circumstances beyond Dotberry's control.

2.3.

Dotberry may, at its sole discretion, block, suspend, or delete an account that has been inactive for an extended period, provided that you have been notified by email at least 30 days in advance.

3.

Services

3.1.

Dotberry provides the following core services:

  • domain name registration in available TLD zones;
  • DNS record management;
  • WHOIS data protection (private registration);
  • other services set out in the pricing schedule at dotberry.com.
3.2.

Services are provided "as is" and "as available". Dotberry does not guarantee continuous or uninterrupted operation of the services where this is caused by circumstances beyond Dotberry's control, including registry actions, regulatory actions, or infrastructure failures.

3.3.

Dotberry acts as an accredited registrar or partner of an accredited registrar in accordance with ICANN requirements. Domain name rights vest in the User upon confirmation of registration by the registry of the relevant domain zone.

4.

Accuracy of Registrant Data

4.1.

When registering a domain name, you must provide accurate information required for entry into the registry of the relevant domain zone. The required data is determined by the rules of the specific registry and may include:

  • registrant email address;
  • DNS server (nameserver) data;
  • other information required by the registry of the specific domain zone.
4.2.

If the registry rules do not require the provision of personal data (name, address, phone number), Dotberry does not collect or store such data. For domain zones where the provision of such information is required by the registry, you may use the private registration service.

4.3.

Wilful provision of knowingly false or misleading information constitutes a material breach of this Agreement and may result in the suspension or cancellation of the domain registration in accordance with ICANN and registry policies.

4.4.

If information required to maintain a registration changes, you must update it in your dotberry.com account within seven (7) calendar days of the change.

5.

Payment

5.1.

Current pricing for registration, renewal, transfer, and other services is published at dotberry.com/pricing. Dotberry may change its pricing; new prices apply to transactions initiated after the publication of the changes.

5.2.

Dotberry accepts the following payment methods:

  • cryptocurrencies: Bitcoin (BTC), Ethereum (ETH), USDT (TRC-20, ERC-20), and other coins listed on the payment page;
  • Visa/Mastercard bank cards via the Stripe payment provider (this feature will be available once connected; current status is shown on the website).
5.3.

All payments are final and, unless expressly provided otherwise in this Agreement, are non-refundable. In particular:

  • a payment for domain registration is non-refundable once the registration is confirmed by the registry;
  • each domain renewal transaction is final, non-refundable, and ineligible for account credit.
5.4.

Dotberry may suspend or terminate services in the event of any outstanding payment obligations.

5.5.

Cryptocurrency payments are processed at the exchange rate at the time the transaction is initiated. Exchange rate fluctuations following payment confirmation are not grounds for recalculation or refund.

6.

Domain Renewal

6.1.

Dotberry does not guarantee automatic renewal of a domain name. You are solely responsible for timely renewal of registration and for monitoring expiry dates.

6.2.

Dotberry sends expiry notifications to the email address associated with your account at 60, 30, and 7 days before the expiry date. Dotberry is not liable for the loss of a domain if a notification was not received or read for reasons beyond Dotberry's control.

6.3.

If auto-renewal is enabled, Dotberry charges the balance. If the charge cannot be processed, auto-renewal does not occur. Dotberry will notify you of a failed charge.

6.4.

All renewal transactions are final, non-refundable, and ineligible for account credit.

7.

Post-Expiry Period

7.1.

A domain name not renewed before its registration expiry date enters a post-expiry period (the "Grace Period"). The Grace Period lasts 30 (thirty) calendar days, unless a shorter period is established by the rules of the relevant registry.

7.2.

During the Grace Period:

  • the domain name receives Hold status and its delegation is suspended;
  • you lose the right to use the domain name, including the right to change registrant data or earn revenue from domain parking;
  • Dotberry may provisionally renew the domain registration on your behalf solely to preserve the possibility of restoration; such a provisional renewal does not grant you any rights to the domain.
7.3.

If the Grace Period expires and the domain has not been renewed, the domain name enters a deletion period (the "Deletion Period") lasting 30 (thirty) calendar days. During the Deletion Period, the registry may flag the domain for deletion.

7.4.

Restoration of a domain in the last 10 (ten) days of the Grace Period is subject to an additional restoration fee in accordance with the current pricing schedule.

7.5.

Upon expiry of the Deletion Period, a domain name that has not been sold at auction or restored becomes available for re-registration by third parties.

7.6.

The terms of this section apply subject to the rules of the specific registry, which may establish different periods or procedures.

8.

Domain Transfer

8.1.

You may request that Dotberry transfer a domain name from another registrar to Dotberry, or from Dotberry to another registrar, subject to the conditions of this section and registry rules.

8.2.

A domain name transfer is not possible in the following circumstances:

  • within 60 (sixty) days of initial registration or the last change of registrant;
  • where you have outstanding obligations to Dotberry;
  • the domain name has Hold or Lock status;
  • a dispute regarding the domain name is pending in accordance with ICANN policies;
  • within 60 (sixty) days of restoration of an expired domain name;
  • a court order prohibits the transfer;
  • registry rules prohibit the transfer at the relevant time.
8.3.

A domain name transfer requires explicit authorisation from the registrant or an authorised agent. You authorise Dotberry to act as your agent to approve requests for change of registrant and to opt out of the 60-day transfer lock.

8.4.

Dotberry is not responsible for the expiry date of a domain name following a transfer, as this is determined by the policies of the registry and the previous registrar.

9.

Suspension and Termination of Services

9.1.

Dotberry may, at its sole discretion, suspend, restrict, or terminate the provision of services, and delete, block, or cancel an account or individual service, if:

  • you have breached the terms of this Agreement or the Acceptable Use Policy (Part III);
  • your account or domain has been used for unlawful purposes, including but not limited to: spam, phishing, distribution of malware, fraud, or infringement of intellectual property rights;
  • required by a regulator, registry, or ICANN;
  • a court order or order of a competent authority has been issued;
  • there are reasonable grounds to believe that use of the domain or account is causing harm to third parties or to Dotberry's reputation.
9.2.

Dotberry will notify you by email before suspending services, except where immediate suspension is necessary to protect the interests of third parties or Dotberry.

9.3.

Dotberry will not compensate for any unused subscription period in the event of service termination on the grounds set out in clause 9.1.

10.

Resale and Licensing

10.1.

If you resell a domain name to a third party through Dotberry services or on third-party platforms, you must:

  • notify the buyer that the domain name is registered through Dotberry;
  • ensure that the buyer has read and agreed to the terms of this Agreement;
  • ensure that the terms of your agreement with the buyer do not conflict with this Agreement.
10.2.

If you grant a third party the right to use a domain name (licence), you remain fully responsible to Dotberry for compliance with the terms of this Agreement in respect of that domain, as well as for any harm caused by the licensee's wrongful use of the domain.

10.3.

You warrant that the registration of a domain name and its use do not infringe any intellectual property rights, trade marks, or other lawful rights of third parties.

11.

Limitation of Liability

11.1.

To the maximum extent permitted by applicable law, Dotberry is not liable for:

  • service interruptions or access delays;
  • loss of data or failure to deliver data;
  • unauthorised access to your account due to circumstances beyond Dotberry's control;
  • errors or omissions in information provided by Dotberry;
  • loss of a domain name due to failure to renew or late renewal;
  • actions of registries, regulators, authorities, or third parties with respect to a domain name;
  • failed or erroneous processing of a transfer;
  • any indirect, incidental, or special losses, or lost profits, regardless of whether Dotberry was advised of the possibility of such losses.
11.2.

Dotberry's aggregate liability to you for any single incident shall not exceed the amount actually paid by you to Dotberry for the service giving rise to the liability during the 12 (twelve) months preceding the event.

11.3.

This Agreement does not exclude or limit any liability that cannot be limited under the mandatory provisions of applicable law.

12.

Governing Law and Dispute Resolution

12.1.

This Agreement is governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (PRC), without regard to conflict of laws principles.

12.2.

All disputes arising out of or in connection with this Agreement or the use of Dotberry services shall first be referred to negotiation. If no resolution is reached within 30 (thirty) days of a written claim being submitted, the dispute shall be referred to the competent courts of Hong Kong.

12.3.

For disputes relating to domain names under ICANN policies, including UDRP proceedings, you submit to the jurisdiction of the courts of your domicile, as well as to the jurisdiction of the courts of Hong Kong.

12.4.

The limitation period for claims relating to the use of Dotberry services is one (1) year from the date on which the right of action arose, unless a longer period is required by the mandatory provisions of applicable law.

Privacy Policy

Protecting user privacy is a core principle of how Dotberry operates. We collect the minimum data necessary and do not share it with third parties for commercial purposes.

1.

Scope

1.1.

This Privacy Policy applies to any person who uses dotberry.com, creates an account, or uses Dotberry services.

1.2.

This Policy may be updated periodically. The current version is always available at dotberry.com/terms. Continued use of the services following publication of any changes constitutes your acceptance of the updated Policy.

2.

Data Protection Contact

2.1.

For any questions about the processing of your personal data, please contact Dotberry's data protection support team via the contact form at dotberry.com/support.

3.

What Data We Collect and Why

3.1.

Dotberry adheres to the principle of data minimisation. We collect only the data necessary to provide the services you have requested. The data we collect includes:

  • Email address — to create an account, deliver service notifications, confirm transactions, and communicate with you.
  • Domain data — information you provide upon registration (nameservers, registrant data to the extent required by the registry of the specific zone).
  • Technical data — IP address, browser data, pages visited, timestamps — for security, fraud prevention, and service stability purposes.
  • Payment data — blockchain transaction identifier or Stripe payment provider token. Dotberry does not store card numbers or full payment credentials.
3.2.

Dotberry does NOT collect: name, surname, postal address, or phone number — unless required by the mandatory rules of the registry of a specific domain zone. In cases where the registry requires such data, you may use the WHOIS Privacy service to hide your personal data from the public WHOIS.

4.

With Whom We Share Your Data

4.1.

Dotberry shares data with third parties exclusively in the following circumstances:

  • Domain zone registries and ICANN — to the extent required by accreditation conditions and the rules of the specific registry.
  • Payment providers — identification data required to process and verify a payment (e.g. Stripe).
  • Information security agents — to a limited extent necessary to prevent fraud.
  • Government authorities — as required by law or a court order.
4.2.

Dotberry does not sell, rent, or share your data with advertising networks or other third parties for commercial purposes.

5.

Data Security

5.1.

Dotberry applies technical and organisational measures to protect your data against unauthorised access, loss, alteration, or destruction. Data transmitted between your browser and the website is encrypted using TLS/HTTPS.

5.2.

In the event of a data breach that may cause material harm to your rights or interests, Dotberry will notify you by email within a reasonable time following discovery of the incident.

6.

Your Rights

6.1.

You may at any time:

  • request confirmation as to whether Dotberry is processing your personal data, and obtain access to it;
  • request correction of inaccurate or out-of-date data;
  • request restriction or cessation of data processing;
  • request deletion of your personal data if it is no longer needed for the purposes for which it was collected.
6.2.

Dotberry may decline to comply with a request for deletion or restriction of data processing if such compliance:

  • conflicts with Dotberry's legal obligations to a registry or ICANN;
  • is necessary to protect Dotberry's legitimate interests in legal or other proceedings;
  • conflicts with other mandatory requirements of applicable law.
6.3.

To exercise any of the above rights, submit a request via dotberry.com/support. Dotberry will respond within 30 (thirty) calendar days.

7.

Data Retention and Deletion

7.1.

Dotberry retains your data for no longer than is necessary for the purposes set out in this Policy, or as required by the mandatory provisions of applicable law and registry rules.

7.2.

Following deletion of your account, your personal data will be deleted or anonymised within 90 (ninety) days, except for data that must be retained pursuant to registry, ICANN, or applicable legal requirements.

8.

Registration Data Disclosure Requests

8.1.

Dotberry considers requests from third parties for disclosure of a domain owner's registration data. To submit such a request, send an email to legal@dotberry.com attaching:

  • the requestor's details and authority (power of attorney where applicable);
  • a list of the data requested;
  • the legal basis for disclosure;
  • confirmation of good faith.
8.2.

Dotberry will acknowledge receipt of the request within two (2) business days and provide a response (data or a reasoned refusal) within thirty (30) calendar days.

Acceptable Use Policy

1.

General

1.1.

This Acceptable Use Policy applies to all users of dotberry.com and all Dotberry services.

1.2.

Use of Dotberry services in breach of this Policy constitutes a material breach of the Agreement and entails the consequences set out in section 9 of Part I.

2.

Prohibited Uses

2.1.

It is prohibited to register domain names or use Dotberry services for:

  • sending unsolicited bulk messages (spam);
  • phishing, pharming, distribution of malware, or operating botnets;
  • fraud, deceptive practices, or misleading consumers;
  • infringement of copyright, trade marks, patents, or other intellectual property rights of third parties;
  • cybersquatting — registering domains that intentionally imitate third-party trade marks with the aim of resale or unjustified gain;
  • hosting, distributing, or accessing unlawful content under applicable law;
  • harassment, threats, incitement of hatred, or discrimination on any grounds;
  • violation of third-party privacy or unauthorised collection of their personal data;
  • actions that destabilise internet infrastructure or Dotberry systems.
2.2.

Dotberry is not responsible for content hosted on domains registered through Dotberry and does not pre-moderate such content. However, Dotberry may respond to substantiated complaints in accordance with this Policy.

2.3.

To submit a complaint about a breach of this Policy, contact abuse@dotberry.com, specifying the domain name and a detailed description of the violation.

TLD Rules. Additional Terms for Domain Zones

By registering a domain name in any of the zones listed below, you accept the additional terms of the relevant registry alongside the terms of this Agreement. Current links are published at dotberry.com/terms#tld-rules; in the event of any discrepancy with the links below, the version on the Dotberry website shall prevail.

Registry rules may impose restrictions on who is eligible to register, as well as additional data requirements for registrants. Please review the rules of the specific registry before registering a domain.

A full and up-to-date list of supported domain zones with links to the relevant registry terms is available at dotberry.com/terms#tld-rules. If a zone you need is not listed above, the rules of its registry apply in full from the moment of domain registration.

Final Provisions

Severability. If any term of this Agreement is found to be invalid or unenforceable, the remaining terms shall remain in full force and effect.

Waiver. Dotberry's failure to enforce any term of the Agreement in a specific instance does not constitute a waiver of the right to enforce it in the future.

Language. This Agreement is made in Russian and English. In the event of any conflict, the rule set out in clause 1.5 of Part I applies.

Entire Agreement. This Agreement, together with the TLD Rules and other documents incorporated by reference, constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior understandings.
